The uMkhonto weSizwe Party (MKP) has come out swinging against the Western Cape High Court’s recent judgment, which barred Dr. Mandlakayise John Hlophe from participating in the Judicial Service Commission (JSC) process.
MKP spokesperson, Nhlamulo Ndhlela slammed the ruling as “incompetent, irrational, and absurd,” accusing the court of “gross judicial overreach” and disregarding the Constitution.
Ndhlela argued that the court’s decision to interdict Dr. Hlophe from the JSC process goes against Section 178 of the Constitution, which guarantees the official opposition party’s right to designate MPs to serve on the commission.
He called the judgment a “constitutional stalemate deliberately created by the incompetent, politically-driven, and compromised Judiciary.”
The MKP has announced plans to appeal the ruling and continue their fight for Dr. Hlophe’s participation in the JSC.
Ndhlela emphasised that there is nothing in the law or Parliament’s rules preventing Dr. Hlophe from taking part in the commission’s proceedings.
In a bold move, the MK Party has called on supporters and like-minded organisations to join them in preventing the JSC’s scheduled sitting on October 7, 2024, without Dr. Hlophe’s involvement.
Ndhlela promised a detailed plan of action will be announced soon.
